USCIS Increases Green Card Validity Extension for Renewal Applicants

  • Effective September 26, 2022, USCIS increased the automatic extension given to green card renewal applicants to 24 months, up from an automatic 12-month extension under the previous policy.
  • Lawful permanent residents who correctly file a Form I-90 request to renew their green card will receive a Notice of Receipt of Request documenting the new 24-month extension.
  • USCIS should update its M-274 manual for employers to reflect changes to Form I-9 employment eligibility verification purposes under the new policy.

New Digital Nomad program coming soon

  • From October 1, 2022, the Malaysian government will begin accepting online applications for the new Digital Nomad Pass under the DE Rantau Nomad Pass program.
  • Eligible foreign nationals who earn more than $24,000 per year will be able to apply for the Nomad Pass.
  • Nomad Pass holders will be able to stay and work in Malaysia for up to 3 to 12 months initially, with the option to extend up to 12 months by request.

DHS Expands and Redesignates Burma (Myanmar) for Temporary Protected Status; Expands relaxed employment options for Burmese F-1 students

  • The Department of Homeland Security (DHS) has extended and renamed Burma (Myanmar) for Temporary Protected Status (TPS), from November 26, 2022 to May 25, 2024.
  • The initial enrollment period for new TPS applicants will run from September 27, 2022 through May 25, 2024. Eligible individuals will also be able to apply for TPS-related Employment Authorization Documents (EADs) and travel authorization during this period.
  • Current Myanmar TPS recipients who wish to extend their benefits will need to re-enroll by November 26, 2022. Those whose EADs expire on November 25, 2022 will receive an automatic one-year extension, until November 25, 2023.
  • DHS is also extending the suspension of certain employment authorization rules for Myanmar students with F-1 status who are experiencing severe economic hardship as a direct result of the humanitarian crisis in Myanmar.

Deployment of Electronic Travel Authorization for visa-exempt travelers to begin in January 2023

  • The UK will start rolling out its ‘Electronic Travel Authorisation’ (‘ETA’) issuance system as part of its ‘Authorization to Travel Scheme’ for visa-exempt travelers from 2023, with full operations expected to be in place by Q3 2023.
  • The ETA application process should take less than 15 minutes and a decision within 78 hours.
  • Obtaining an ETA is not the same as obtaining a visa. The ETA is simply a digital travel authorization for visa-exempt travelers visiting the UK. It only allows one person to board a plane to travel to the UK. It is comparable to ESTA in the US and is designed to strengthen UK border control and compliance.

  • Entrants have Wednesday, October 5, 2022 at noon EDT through Tuesday, November 8, 2022 at noon EST to enter online at the official Department of State Diversity Visa Lottery website.
  • Lottery applications must comply with strict Department of State requirements.
